Unfortunately this agency is proving to be nothing more than a rubber stamp agency for the oil and gas industry. When spills are reported that look (and smell) like they may be diesel-based drilling mud, this agency insists they are nothing more than 'water-based' drilling mud, EVEN THOUGH THEY DID NO SOIL TESTING TO CONFIRM. Statutorily there is only two reasons they can refuse a oil/gas well application. 1) If the 'resource' will be wasted; or 2) If groundwater will be impacted. I'm not sure how you 'prove' something will be impacted until it is. Unbelievably, there is NO requirement that the public's health, welfare or safety be considered when they are considering drilling permits. There is NO requirement for baseline water testing prior to drilling an oil/gas well. There is NO requirement for baseline air testing prior to drilling an oil/gas well. This agency testified in favor of S1339, a bill that STRIPS PRIVATE PROPERTY RIGHTS from Idaho homeowners and landowners. It takes away the ability of homeowners and landowners to negotiate decent leases, because all the oil and gas company has to do is get 55% of the mineral rights in a section leased, then they can FORCE everyone else to go along-- on THEIR terms. No negotiation. They testified that they were in favor of a law that STRIPS due process-- by not allowing an organization to intervene on behalf of their affected members. It STRIPS due process by refusing to allow discovery (the ability of an affected homeowner/landowner to 'look' at the oil and gas company's evidence that they have to FORCE integrate you). It prevents you from even verifying that the company has actually met the 55% requirement because all they have to do is submit an affidavit-- you can't actually verify the numbers yourself. It allows an oil and gas well TO BE PLACED ANYWHERE THAT INDUSTRY WANTS IT TO BE WITH THIS LANGUAGE, "If the department finds that a well drilled at the prescribed location would not be likely to produce in paying quantities, or that surface conditions would substantially add to the burden or hazard of drilling such well, or for other good cause shown, the department is authorized to make an order permitting the well to be drilled at a location other than that prescribed by such spacing order." In other words, this PUBLIC agency, that utilizes TAXPAYER dollars to pay staff salaries, is NOT looking out for the PUBLIC, but actively campaigning to pass laws that HURT We The People. That's why I've only given them one star, and if I could, I'd give them -100! Alma Hasse
