Good we would like to take a few moments to express our thoughts and experience working with Ashley Burton. The situation was difficult and at times disheartening. Throughout this ordeal Ashley displayed total professionalism, confidence and strength in her dealings with us. If there were questions she handled them, at times when understanding and empathy were required she stepped up. While we understand full well that the business of insurance is not always pleasant and can be not only difficult but trying for all involved, it was fortunate for us to have a knowledgeable thorough individual in Ashley to be our contact. It is unfortunate that people take time to complain more often than taking the time to commend a deserving individual. We are taking that time as Ashley made a positive professional impression with us and we feel this should be recognized. Thank you
After purchasing our waterfront property we had a survey done which indicated an encroachment by our neighbours. We filed a claim and were turned down for various reasons. So we brought an application against the neighbours at our expense. The neighbours then claimed adverse possession of a portion of our property, including a good chunk of our waterfront.We went back to Stewart and once again were denied, even though their policy explicitly states they will provide a defense against adverse possession. They did, "AS A MATTER OF GOOD FAITH", offer to pay for the redrawing of the lot lines. How generous. So we continued to rack up legal bills. Finally we were forced to bring a lawsuit against Stewart. But did they agree to provide us with a legal defense as their policy states? Oh no. As someone has already stated, they have fine print in their policy to enable them to weasel out of their obligations. For example, buried in the fine print is a paragraph in which they “assert their rights” to provide a payout in lieu of a legal defense. So they essentially concede defeat, throw in the towel and write you a cheque instead of defending you like their policy promises. It is a very winnable case. Adverse possession is very difficult to prove. Then of course they low-ball in their payout. In our case, they or their lawyer calculated the value of the land we would lose. But their calculation failed to take into consideration that it is waterfront. They simply calculated the value of one square meter, and multiplied that by the number of square meters in the neighbour's claim. So in their eyes the value of the waterfront portion of our property is the same as any random portion of the same size. They came up with a figure of $5000 and change, when in reality the land, being on the waterfront, is worth much more. They offered to pay our legal costs but only those incurred after the claim for adverse possession was received, not for the legal fees we incurred upon discovery of the encroachment. Therefore, under their offer, we would be out $28,000 in legal fees, we would have lost a significant portion of our waterfront for which we would be paid a fraction of its worth, we still have a lawsuit to fight with our neighbours, and have an ongoing lawsuit with Stewart. Now they are withholding the funds they initially offered. So to date we have received a grand total of $0.00 and it has been almost 3 years since we approached them.
If you are going to get a mortgage, spend a few hundred dollars and invest in title insurance. It will protect you as a buyer and also stays in effect to protect you from fraudulent loans against your home once your mortgage is paid off. Pay once and be protected for as long as you own the property.
I just LOVE using Stewart Title Insurance if not exclusively if we can. I am in Calgary and our representative Brent Cooper is just so hands-on and ALWAYS available. If for any reason, which is almost never, a file is flagged, I email Brent for help and he is already emailing/phoning/assisting me and whomever else to ensure the policy is completed very fast. Brent is such a personable person that I believe Stewart Title couldn't have a better person for this role. I enjoy the program to order the policy online and never have any issues.
We used Stewart Title for title insurance on our cottage. We purchased the Gold Policy and access was included in the policy. When we sold the cottage, the access clause had mistakenly been removed, apparently when we purchased the road allowance. Stewart Title was quick to find a loop hole to decline coverage. "If you and the Insured elect to grant the undertaking as demanded by the Purchaser, please be advised that Stewart Title will not pay for legal services or other costs associated with honouring or completing the terms of such undertaking, including court matters. As set out above, the costs associated with the Land Registrar’s failure to incorporate the RoW into the land titles converted qualified parcel register for the Land are excepted from coverage. Regrettably, for the above-noted reasons, this claim inquiry does not fall within the parameters of the Policy’s coverages." The purchasers refused to close unless We resolved the issue, which we will pay for out of pocket.
