***If you are arrested for a crime in Berlin there is a strong possibility that your mugshot will be posted on the Department's Facebook Page. Arrests which are made in the Town of Berlin and become public information via press release to local news outlets are often posted on our Facebook account. The intention is not to publicly shame an individual and people commenting on the photos should consider this when posting under the mugshot or press release. The Berlin Police Department wants to keep the community aware of criminal activity that is occurring in the City and hopefully deter others from committing crimes. If you have information related to a recent arrest or recognize the person(s) as a suspect in another crime, please contact the Berlin Police.
Law pertaining to Public Records can be found at http://legislature.vermont.gov/statutes/section/01/005/00317. Please carefully read this statute before complaining about mugshots, press releases involving arrests and other issues involving public information. In 2014, when the public records law was revamped it was discussed with legislators that making arrests public prior to any court adjudication subjected someone to public scrutiny even before the matter was reviewed by a judge. Legislature did not alter this section of the law and made it clear that all "records reflecting the initial arrest of a person ... shall be public." We at The Berlin Police Department abide by this law and make them public.
