I'm was defrauded by the Century 21 Award agent in Rancho Santa Margarita. She was dual agent (told me that she will not accept my offer unless she is my agent), she did not enforce provisions of the purchase agreement on the seller (seller was late with disclosures and termite report, did not provide accounting of repairs done, termite inspection report was incomplete, termite certification of completion was issued while fumigation was still in progress (illegal in California) and repairs were not done etc, etc. While house was advertised as pristine and meticulously maintained, house had slab leak in the hall, mold and water damage in the kitchen, faulty wiring, faulty drainage (when it rains water accumulates in the backyard making walls of the house wet and damaging wooden jambs and door frames). None of those issues were identified in house inspection report, seller disclosures or agent visual inspection. In addition, agent directed termite extermination company to issue certificate of completion despite that repairs were not done, and she told buyer to sign escrow papers and wire deposit claiming that all repairs (including fumigation) were done when repairs were not done and fumigation did not start yet. Buyer discovered that fumigation was not done once she came for "final" walk through " and found out that fumigation company is putting tents on the house. Buyer complains to escrow and real estate office were disregarded. Buyer never received CMA (comparable market analysis) for the area she was buying house in. Instead she was provided summary list of addressed of properties that allegedly were comps. Those comps were located 2 to 3.5 miles away in newer and more prestigious area of Mission Viejo, most comps had view of the lake and city lights, had new roofs, new kitchen, new hard wood floors etc. . While subject property was listed at $725,000, the comps average value was $775,000 to secure higher price of the property. Appraiser was influences by the real estate agent and used newly renovated houses with new roofs, new kitchens, new hard wood floors etc as comps to justify value of the 41 years old house with 41 years old appliances, slab leak, mold etc. Shortly after escrow closed buyer discovered massive, multi year mold in the kitchen that led to removal of kitchen cabinets and dry walls (kitchen was gutted tot he studs). In addition there was slab in the hall closets. Buyer house insurance has been cancelled. When it rained buyer found out that water accumulates in the backyard. OC assessor reduced baseline value of the house by $48,000 from $720,000 to $672,000 and added additional reduction in property value of $632,000 to account for the poor conditions of the house. I'm hoping that despite of the work load, Bureau of the real estate will review my complaint and take action to prevent similar kinds of situation from happening in the future. Deal agents should be made illegal in California (they are already illegal in numerous other states), since any checks and balances (however tenuous to start with) are completely removed when listing agent is representing seller and buyer. The clear beneficiary of that arrangement is that listing agent who does not need to share its commission with anyone else, but (as it happened in my case) buyer might end up not being represented by the agent.

I renewed my broker's license prior to expiration and my check was deposited but the renewed license has not appeared on line. What is the problem?
